  1. Pluribus I'm on board with what you're saying. I think Jimmy has very much one of those nagging on / off *injuries*. Not an injury as in actual break, but something that can and will flare up here and there. It probably was not as aggravating post Zep since he wasn't playing or touring as extensively - meaning 3+ hour long shows. I wonder if flared up again when he was practicing for the 02 gig. I have to ask are you referring to the picture of Jimmy holding his hand for the camera with a tensor bandage wrapped around his hand and wrist? I do think the fact his fingers in the picture have absolutely no swelling and he's able to keep them apart tells me he didn't have a broken finger, but it was something nagging that forced him to change his playing style. Pitchers who have even the smallest injuries on their hands and fingers are forced to change how they throw. It can be something as minor as a blister, so for a guitarist who gets a bruise or sprain and then tries to go out and play 3 hour shows multiple months in row I can see that causing a problem - hence why Jimmy changed his playing approach.

  3. Yeah I was surprised at how many pieces of music there are. A lot of the members on this board had mentioned many of them, but so many more have been added. Hopefully Zep's lawyers present it to the jury in a nice little package done up with a bow. So far the plaintiff hasn't impressed me with any of his findings. So much of his evidence is so irrelevant, but like Walter said who knows what goes through the juries heads. I'm biased towards Zep of course haha.
  4. Twitter Balthazor!! I follow @LedZepNews who happens to be re- tweeting out 2 ladies who are at the trial. So far the reports coming from the journalists at the trial - Jimmy sounds like he's handling it well. Good eye contact, winking, smiling and apparently a little dance. Not that 'fans' in the courtroom watching the trial matter....but who knows if jury members are picking up little things like their nodding in approval when Jimmy was giving his testimony - almost like *yeah this guy is telling the truth* Ha-ha I'm hoping the jury are enthralled with Jimbert - maybe some of them will end up being Led Zep fans after this Question: If Zep would lose and have it appealed would Judge Klausner be factored into it again, or does a new judge sit in? I ask because I think this is the LAST thing this judge would like to see happen. If Zep wins then the book will be closed. Right now the Judge appears as if the case Francis is grating on his last nerve and to deal with this shit again wouldn't be his cup of tea Personally I don't see how the jury isn't noticing Malofiy as an annoying gnat. The journalist are making a point of bringing up how the Judge isn't a fan of his. If it wasn't something that was noticable during the trial, I don't think ALL would be mentioning it in their reports.

After multiple sustained objections, U.S. District Court judge R. Gary Klausner had enough. "Nobody cares," he said. "It's not an issue in this case."..... ....What followed was largely Malofiy quizzing Page on musical vocabulary and the first notes of "Stairway." Then the attorney played "Chim Chim Cher-ee" from Mary Poppins and asked Page whether or not he was familiar with the tune and if it inspired "Stairway" -- which Malofiy claims the guitarist had said previously. Klausner again tired quickly of the apparently frivolous questions and snapped, "You've wasted a huge amount of time."....... ....As attorneys for both sides squabbled about whether exhibits were shared beforehand, the judge admonished the lack of professionalism in discovery in this case -- at one point he called it abominable...." I looked at the list of exhibits that Led Zeppelin would present and it appears more withstanding and valid. The number of musical pieces dating back as far as 1600s. A lot proving that there isn't any plagiarism taking place between the two songs. The plaintiff side is hell bent on repeating he/said she said stories from super fans from 45 years ago, ex band members who say they hung around Led Zeppelin members at parties to only turn round and admitt it was only briefly for a minute or less, or bringing up that Jimmy has 50 gazillion records and CDs and few of them happen to be Spirits - Nothing that proves ANYTHING other than Jimmy Page loves music.   6. Yeah no kidding about Francis. He is in fact an obvious pain in the ass to the Judge. I hope the jury finds him irritating as well. "...by the end of the trial's second day, Malofiy had racked up sustained objections in the double digits, at times exasperating the presiding magistrate. (At one point during Malofiy's questioning, Judge Klausner yelled out "Sustained!' even before the defense had time to object.) Klausner castigated Malofiy repeatedly from the bench, at one point asking the attorney, "How many times can you beat a dead horse?" I also read that the Judge already warned Malofiy of a mistrial. I can actually see that happening to be honest. Andes recounted in his testimony. "I played snooker with Robert Plant and we were definitely drinking." Andes was undermined, however, under defense lawyer Peter Anderson's ruthless cross-examination. Contrary to his earlier testimony, the Spirit musician was forced to recant that Page was not in attendance at the group's Mother's show and that any meeting with Plant at the meet-and-greet would've lasted "about a minute." How quickly he goes from Robby and I were besties playing snooker and clinking beer glasses all night in the pub.... to err.. he was only in my presence for maybe 60 seconds.. I heard during the selection of the jury, one of the possible members shouted out that they were big fans of Led Zeppelin and gestured that they loved Jimmy and Robert Haha obviously he was dismissed.   9. The picture of the dude a couple of posts above can be found easily when you search Mike Millard images. Anyhoo the link the picture is associated with opens up to a web a page called geni.com. A family tree web site of some sort. The picture represents somebody by the of name Mike (Millard) von Halle. It also says he has a wife by the name of Barbara née (Meacham) Millard was Mike's fathers first name. I suppose he could have used his middle name as a last name within a 'trading' circle, but the wife card has never been mentioned with him.
  10. Some of the recollecting dear Jimmy has made regarding Spirit sounds a bit questionable, but how can Francis prove that to a jury? Let me say I don't think Zep is guilty of plagiarism, but for Jimmy to say he had NEVER heard of the song Taurus until ? 2014 sounds a little silly. Many moons ago he would've heard the rumblings of people claiming Stairway's intro sounded somewhat simular to Taurus, and in my personal opinion I would think out of mild curiousity he would have checked that out. And what does that matter? Listening to a song does not make somebody guilty of jack shit does it! I guess Zep is being told to deny deny deny when it comes to hearing Spirits music since there really isn't any evidence proving otherwise. Old interviews can't be used as evidence can they? At least they shouldn't be. Magazines can be fudged, words taken out of context or down right made up. That is not proof for me, since those things can easily be misconstrued. Besides who knows how many of these music journalist were interviewing the bands in their hotel suites, or on Zep's plane sniffing, swallowing, smoking or shooting up the drug du jour as well. I need to add that I hate that this trial has taken away from the the members doing anything productive musically / artistically. A lot of walking on egg shells and being all hush hush waiting for this trial to start. And to ever thinks this thread is depressing *Hugs* Whatever the outcome we still love Zeppelin!!

  12. Brad Tolinksi. Yeah I wonder what he could offer up on Zeps behalf? What could he say to a jury that would work favorably for Zep? I dont believe he can hurt their case, but him being a witness is a bit errr O__o pour moi too. Only thing I know is Jimmy and Robert must trust what his testimony is about. There are not a lot of journalist they can say that about They only have 10 hours to present their case, so who they choose as a witness for their side has to offer up something valuable. Only thing I can think of is maybe he's a character witness for them vouching they are both professional and good guys? I'm sure Francis wishes he could just pass out Richard Cole's book to the jury before hand. Hahaha I don't know. I'm guessing here. I'm throwing stuff against the wall and seeing what will stick people.
  13. From Led Zep News on Twitter. Apparently Jimmy, Robert and John Paul WILL be appearing at the trial after all. Jones is hoping to help by tesitifying as a witness for them, along with Brad Tolinski. I assume this means no need for the video depositions since Led Zeppelin will be there live in the courtroom. (Here comes the media circus now that the band members will be there) Go figure eh. Jimmy Page, Robert Plant and John Paul Jones will be Los Angles at the same time. If only it was for something other than sitting in a court room......

The article was an interesting read for sure. It touches on the possibility of what will and could take place during the trial. Something I found interesting is both the potential disadvantage and (to me) advantage of Jimmy and Robert not being present in the courtroom to the jury. A jury is often not as engaged watching a video deposition verse a live person speaking, but it's also not as easy to pick up on certain body language and demeanor during questioning. i.e. hands fidgeting, a leg under a table bouncing, breathing rates, eye contact or lack of. etc. Now I don't know Jimmy personally at all - I can only go by what he exposes in public. I am sure many of you have watched Jimmy in his interviews. When the man is uncomfortable I think it shows BIG time in his voice and body language. He doesn't hide his uneasiness very well. He fidgets about, appears and sounds anxious, and when he's asked things that put him in the hot seat he becomes quite evasive and defensive with his answers. I am sure Zeppelin's legal team did a good job coaching both he and Robert on that kind of thing. I do hope Pagey and Plant are both very relaxed and poised in their depositions. He also touches on this new witness Michael Ware. That's basically going to be Francis trying to convince the jury this guy is credible, while Zep's side proves he's not. Unless this man all of a sudden comes up with something incredible to back his story up, I want to give my point to Zeps side on that matter. Ah but I'm not the one you gotta convince. It's hopefully 12 people who see Zep as the innocent party. I wish the Zep guys luck on this case. I'm really hoping they get the "W"

But wouldn't that be the luck of it. He'd be in a L A court house playing Stairway for 12 people who could care less about his playing. (Can't see a fan being allowed on the jury) I dunno maybe if Zeppelin's legal team felt Jimmy playing could help prove something concrete to make the case.......Although I'd make Jimmy play beer barrel polka on the accordion if it meant Zep would win HA! what a thought!! It'd be nice to have Zeppelin in the media again for something other than Randy California and talk about lifting other musicians songs. What's ahead for musicians in 2016 onward? There needs to be a line drawn with what's considered plagiarizing. It could get so out of hand. This case is already proof of that. More and more cases could happen with the way music is 'borrowed' down the line these days. You could have a field day with hip hop artists and rappers and all the sampling they do.

His goal was for the jury to hear something similar between the 2 songs I bet, but c'mon you don't need Jimmy to be the person to do that. A qualified guitarist anywhere in the U S A can play what's needed to be demonstrated to the jury. There's no need for airfare between Heathrow and L A X by the band members. And what's with the plaintiff witness Michael Ware? So he claims to have hiked 100 miles with his friend to watch Spirit. He says he watched Robert Plant having the time of his life at the show. I assume his friend can NOT vouch for this because after the first song he spent the evening in the bathroom. Sooo are there pictures, audio or video of Plant mouthing the words "Man I'm having a great time! Love this effin' band Spirit... Wow this song Taurus could help Jimmy and I out" ?? Probably not, so nothing he says can equate to plagiarism. Just because he can describe the club layout doesn't mean that Plant was in the audience acting as if Spirit was equal to the Second Coming. I am sure a lot of people can also describe what the club looks/ed like inside. Still doesn't prove that Robert Plant was secretly hatching out a plan with Jimmy Page to steal music from them. ************************************************************************** JTM, lpMan While people with Parkinson's may have symptoms that vary. The memory can sometimes be impacted for some people. I'm not saying this mans memory is questionable, but I would think if they are serious about his testimony any unbiased medical doctor would be able to vouch for him one way or another. I just think his testimony is very "He said this, while the other person said that" More opinion than actual fact on what he believes Robert thinks about Spirit's music.

He informed Mr. Skidmore that he attended a Spirit show in 1970 at Mothers Club at Birmingham, England, at which time he saw Plant seated in the first row of the arena as a fan watching Spirit perform. In his email to Skidmore, Ware wrote: "Truth will out, and I think that Plant and Page have dug a very big hole by lying about their relationship with Spirit. They were big fans, as I witnessed in 1970 at Mothers Club, Birmingham because Robert Plant was in the front row watching the band." Ware told Plaintiff’s counsel on the phone that Plant was "thoroughly enjoying himself." On April 20, 2016, Plaintiff’s counsel contacted Mr. Ware to seek to verify whether his version of events was credible. Mr. Ware provided numerous details that led counsel to conclude he was telling the truth, including that he specifically remembered the show because he hitchhiked over 100 miles to get to Mothers Club with a friend and that the friend took ill after the first song and spent the night in the bathroom. Mr. Ware also accurately described the layout of Mothers Club. Mr. Ware informed Plaintiff’s counsel that he is willing to testify at the trial but he is an elderly gentleman who lives in England and suffers from Parkinson’s disease, which makes it impossible for him to travel. IT IS HEREBY ORDERED That Plaintiff’s Motion be and hereby is GRANTED and that Plaintiff may take the videotape deposition of Michael Ware or in the alternative have Mr. Ware testify by way of video conference at trial. ********************************************************************************** The mans word is gospel because 1) while watching Robert, Robert never looked bored, 2) his friend used the bathroom a lot that night, 3) he can describe the layout of the club - therefore it must mean Jimmy and Robert stole the intro to Stairway. Whatever Francis... Was Robert Plant that big of a rockstar in '70 that somebody would've been paying attention to his body language and facial expressions at a small gig 45+ years ago and remembering? If this was even a couple years later in the 70s when Zeppelin became H U G E, I could see someone 'watching' Robert. And do people not ever 'fake' having a good time? Or maybe he looked like that because he had a good buzz going on. I'm sure the guy is being honest per se, but the testimony sounds a bit silly. What happens if somebody can also 'prove' being there, yet says they remember Robert Plant looking bored ZZzzz?
  18. The thread is old, but hey some curious people brought it back to life. I'm adding my .02 to it. I don't know much about Bebe or Audrey's time with Led Zeppelin members other than the usual stuff that most Led Zeppelin message board members know. Bebe hooked up with Jimmy, and Audrey with Plant. I recall reading in a few places that when Jimmy announced he was putting out a book that would look back on his life illustrated with pictures - some noteable '70s groupies assumed they would be gracing the pages. Nope WRONG. Charlotte Martin and Jackie De Shannon represented for the ladies side. Kind of flattering when you think of the long list of females that have been in his life. (I'm not counting Jimmy's daughters) As far as Bebe believing L R C by Prince was about her... uhm to me that's so foolish, but yeah I believe she'd think that. Every "muse" must believe every song was inspired because of her. Audrey can cash in on a book if she chooses. The only thing about former groupies writing books about their involvement with the band is you never known what's true and what's embellished. Sleazy Cole certainly did that when he fabricated so many damn stories about ALL of them. Or maybe some people don't care how much of it is true ha ha
  19. ^^^ Oh so very true. Led Zeppelin had the right people in their back pocket at all the right times. i. e. '73 with their funds stolen? It would've been a cake walk for authorities searching a hotel suite to have found drug du jour. Someone in Zeps camp was wise enough to get rid of that stuff - and was it not Peter who made sure they got Lori the hell outta of Pagey's room? They definitely had some tricks up their sleeves. Amazing that 1977 didn't result in some kind of drug bust. Then again that year had its share of tragedy. The band didn't need to pour more gasoline on the fire. Flash forward to 2016. The Starship and Caesar's Chariot would have kept the airport pooches busy. Zep were lucky they did their "thing" back then. Back to this plagiarism case - I don't doubt Peter Grant alive would do some good, but I don't believe something 'underhanded' would need to be done in order for Zep to win. Nah the evidence is there that proves it should get tossed out. Waste of time. Could the judge end up doing this? Why not? If there's no reason to have a trial then by all means don't.

Soooo the V E R Y small part of the two songs that have been pointlessly argued about was found in a piece written as far back as the 1700s?!? Well jeez duh eh. C'mon Judge toss the case out. I do have to give him mad props for putting his foot down on a lot of things though. The plaintiff wanting to drag Jimmy's name through manure by focusing on his past alcohol and drug addictions, uh ermm NO! In otherwords chalk it up that Jimmy's memory can't be reliable, so therefore he has to be confused/lying in his testimony. Pfft they can piss off with that turd talk. Jimmy's mind is sharp. I say they fold their hand, stand up from the table and walk away. Enough with the attempts being made on trying to get an undeserving fat payout /windfall from Zep
  21. I'm feeling a tad more positive than I was prior to the pre-trial. I think it's a big plus that the jury won't hear about the booze and drug habits, nor previous plagiarism cases or any printed media talking about Stairway opening VS Taurus opening, and Hell Yeah to the quotes a k a "hearsay chatter" being left off the menu as well. And with the judge saying he wants a quick trial most or all of the 'expert witnesses' the plaintiff had lined up are being squashed more or less. Not saying they won't testify, just a lot of stuff they had been counting on has been stymied Still the mere fact this is actually heading to trial is redonk to say the least, but a silver lining besides an obvious Zep victory would mean.. Finito! Game Over for the Stairway vs Taurus bull shit lawsuits. The book would close and all would be merry and well with the Jimbert Stairway writing credits. Now for the jury. A bit of light heartedness here. I'm looking sideways at the white male 50-65 that answered the jury questionnaire honestly and is granted a seat. How can you NOT have even the slightest opinion on Led Zeppelin. Love or hate Zep, a white teenage male living in California in the 1970s not having a voice good OR bad on Zep....really? Do they exist?? Haha. Sighhhh now before somebody says I am using stereotypes to define Zep fans, I'm just being silly. I know anybody and everybody can represent a Zep fan!!

Those who have listened to Spirit's "Taurus" and hear similarity to the opening guitar riff in "Stairway to Heaven" might expect Led Zeppelin to be in trouble at a copyright trial scheduled for May 10. However, don't bet against Led Zeppelin just yet. On Monday, the defendants scored some key victories that will severely limit the testimony and evidence heard by a jury. Perhaps most importantly, U.S. District Judge R. Gary Klausner has decided to exclude many of the "Taurus" sound recordings that the Randy Craig Wolfe Trust (which counts itself as a beneficial owner of Spirit member Randy California's works) wanted to play for the jury. The "Taurus" copyright is limited to what was deposited with the Copyright Office in 1967 and so the judge has agreed with Led Zeppelin that the only recordings to be presented for the jury's ears are ones transcribed from the copyrighted sheet music. What's more, the judge has rejected all of the plaintiff's experts because these musicologists prepared their reports and opinions by relying upon sound recordings that embodied unprotected performance elements. That's not to say for sure that the Randy Craig Wolfe Trust won't have any experts testifying. Judge Klausner has given the plaintiff five days to submit new expert reports "purged" of what's unprotected. Led Zeppelin's pre-trial victories hardly stop there. The band has also gotten the judge to bar any testimony how Led Zeppelin has a history of plagiarism. The jury also won't hear about the wealth of Jimmy Page and Robert Plant. Nor will jurors be able to consider how Led Zeppelin band members used drugs and alcohol. The plaintiffs wanted to use evidence of the latter to throw doubts on Page's recollection that he never heard Spirit's "Taurus" when composing "Stairway to Heaven." In fact, the judge also won't let the jury consider the many newspaper articles and book excerpts that addressed Led Zeppelin's alleged lifting of song craft except for two statements made by Page in magazine interviews. When Page testifies (more on that in a moment), the Randy Craig Wolfe Trust will attempt to use his prior recollections to impeach him. As for what the plaintiff wished to exclude at trial, Klausner has decided to not let Led Zeppelin challenge the validity of Randy Craig Wolfe Trust, but will let the defendant introduce evidence that the "Taurus" copyright is actually owned by Randy California's son, Quinn Wolfe, instead of the Trust. At a hearing yesterday, Francis Malofiy, attorney for the plaintiff, reportedly spoke of his concern that Page and Plant wouldn't present themselves to testify. The judge may not have the authority to order the two U.K. citizens to the trial; On the other hand, both have undergone depositions already that will likely be played for the jury, assuming there's no settlement in the next two weeks that avoids a trial.

  24. Any lawyers in the house? Do the depositions become unsealed at some point? When it comes to legal talk I have an IQ of about 5. It goes pretty much over my head. From what I gather, depending on what will be allowed to be used against Zep - could be the make or break in the case. I'm a bit errrr if the judge says fair game for the jury to hear all the other plagerism cases and hearsay chatter. Maybe Zep's attorneys have an ace up their sleeve? If Zep think they have this one in the bag, power to them. Go to trial and break a leg boys!! But damn if they are on the verge of losing - would handling it out of court be that bad? It's a fairly long read and some of it perhaps has been posted already, but for those following this case, it has your daily dose of lawyer ramblings. Randy's party is playing hardball. It reads like Zeppelin were these notorious song stealing bandits who went around like serial plagiarists lifting music from other artists as if it was as common as breathing for them. The judge better use 'good judgement' and says this is a no-go at the trial. The focus should be on Stairway and Stairway only.
